HI,
My company is processing my Green card and recently applied my I-140. My wife is applying for residency this year. Most of hospitals are saying that they can sponsor only a J-1 visa. Can you please suggest if this would be a problem for my Green Card processing and/or her visa stamping (Since applying for G.C means that we wants to stay and J-1 means the other way round)?

I'm going to India and is planning to get my h1 visa stamped...
How are stamping scenarios these days at Chennai?..esp"lly due to PIMS stuff...
I have followed lot of discussions around H1 stamping and people got struck for weeks/months in India due to PIMS and other issues..
Is it advisable to go for H1 stamping as i'm into 7 th year of extension and I can't afford getting stuck in India for more than the granted period of vacation...I have approved AP documents handy and can use them while coming back to US...
Can someone pls advise me on this?

Hi
I want to transfer my H1-b from a consultant company to a non-profilt organization which is offering me a full time job. I haven't resigned my job at consultant company yet. The LCA process is going on with new non-profilt organisation and then they are going to apply for H-1B petition soon. I am worried if the consultant company will cancel my visa as soon as I resign and that would cause issues for the H-1b transfer. Please advice when is it safe time to resign and start my new job.

Hi,
I got my labor approved couple of weeks back and now attorney is filing I-140. My situation is
Job 1 : Worked from July 1st 2006 to Oct 2nd 2007 (Laid off on that date and h1b was not cancelled ever after)
so applied for h1 transfer immediately, USCIS received application on Oct 9th 2007 (Regular processing)
While I was waiting on that, I got another fulltime job in Nov, Applied for h1 through this company (Premium processing) and got approval within a week, started working from Nov 15th 2007 to till date..
In Decemeber 2007, I got approval for pending H1b from 2nd compnay too.. but never used as i was already working for Company 3.
So, In my labor requirement it was M.S. and 1 yr relevant experience, Labor approval showing employemnt history as
Job 1 : July 1 2006 to Oct 2 2007
Current Job : Nov 15th 2007 to till date
Is it a problem if it shows 1 month gap between these two jobs?

If you apply in April 2011 for 2012 quota, yes you will need to go out on/before June 2011 and come back in october 2011(will need H1B stamping too).
On the other hand, If the H1B quota for 2011, which can be applied from April 2010 is not exhausted until you apply in 2011, You can stay and apply with out any problems, but this seems very remote, if not impossible.

As expected this happened, but it happened sooner than expected.
This expected sooner because CIR was voted out in Senate and this was not thought about by this goverment.
Basically this was a close door arrangement between govt agencies which temporarily wanted to lower the friction by IV AND SIMILAR GROUPS.
BUT finally I believe this will come to a rest once we have new government next year.
Till that we are a tennis ball which can be tossed to any court.
PS: I dont even have I-140 and not even applied for one.
So best of luck to all and me.
